WARRANTIES - WOOD PANEL DOORS
Limited
One And Five Year Wood Panel Door Warranties
TheDoorCompany.com warrants that each of the panel doors sold by it complies
with the National Wood Window and Door Association (NWWDA) industry standard
NWWDA I.S.6., and all revisions in effect as of the date of manufacture.
TheDoorCompany.com further warrants that each Fir, Hemlock and Oak door,
for a period of one year, and each Mahogany door, for a period of five
years, from the date of shipment and at the time of the shipment from
TheDoorCompany.com, is of good material and workmanship and free from
defects that would render such door unserviceable or unfit for the ordinary,
recommended use.
Limited
Five Year Insulated Glass Warranty
TheDoorCompany.com warrants that standard clear and insulated
leaded glass units will not, for a period of five (5) years after the
unit leaves TheDoorCompany.com's possession, develop material obstruction
of vision between the interior glass surfaces caused by failure of the
hermetic seal. This warranty shall not apply to units with broken glass
or to glass units installed by others. TheDoorCompany.com's liability
under this warranty shall be limited to shipping a replacement glass unit.
Lifetime
Innerbond® Panel Warranty
TheDoorCompany.com further provides a lifetime warranty on Innerbond®
panels against splitting through the entire panel due to rain, sun, weather
and other such factors exclusive of major calamity. In the event an Innerbond®
panel splits through, TheDoorCompany.com will ship a replacement door
and will reimburse the reasonable cost as determined by TheDoorCompany.com
to the purchaser for rehanging the replacement door. This offer to reimburse
the cost of refinishing and rehanging the door is VOID in any jurisdiction
where TheDoorCompany.com would have to comply with statutes or regulations
governing insurers in order to legally make such payment.
Characteristics
Excluded From These Warranties
The following are not defects in workmanship or material and are not
covered by this written warranty:
1. Damage caused by attempts other than TheDoorCompany.com's to repair
the door.
2. Damage caused by failure to comply with "Care and Finishing" instructions
provided by TheDoorCompany.com.
3. Natural variations in the color or texture of the door.
4a. This warranty applies to doors properly sealed and finished on all
six sides and hung in a location protected from exposure to direct sun
or rain under normal conditions.
4b. For doors 3' x 7' or smaller; warp not exceeding 1/4" in the plane
of the door itself. For doors larger than 3' x 7'; warp not exceeding
3/8" in the plane of the door itself.
5. Defects caused by (1) warp or bow of the frame or jamb in which the
door is hung; (2) improper hanging of the door; or (3) improper installation
such that the door does not swing freely.
6. Damage caused by improper handling or on-site storage.
7. Panel misalignment or shrinkage is not considered a defect.
8. Surface checking of oak is considered a natural characteristic and
is not covered by this warranty.
9. Problems caused by high humidity (condensation and frost).
10. Damage resulting from failure to perform normal "Maintenance" as
prescribed in the "Care and Finishing" instructions provided by TheDoorCompany.com.
11. The performance or appearance of finishes applied is not covered.
Limitations
And Exclusions
This warranty shall be void and TheDoorCompany.com shall have no liability
hereunder if the purchaser installs, treats or retains, for more than
thirty (30) days, a door containing an obvious defect, without giving
the notice as required herein, or if the purchaser fails to give the required
notice within a reasonable time after discovery of a latent defect.
Doors shipped
out of the continental United States, Hawaii or Canada are not warranted.
If the claimed non conformity is warp, TheDoorCompany.com may defer repairing
or replacing the product for a period of up to twelve (12) months from
the date of claim or the date when the product was installed, as it is
not uncommon for a temporary warp condition to occur as the door adjusts
to local humidity and temperature conditions. This deferral will not be
counted against the warranty period.
This warranty
sets forth TheDoorCompany.com's maximum liability for its products. This
warranty does not cover: products that are not TheDoorCompany.com's, accidents
including accidental door glass breakage, Acts of God, and products subjected
to conditions outside their design limitations.
There
are no express warranties which extend beyond the foregoing and any implied
warranties, including warranties of merchantability and fitness for a
particular purpose, are limited to the same duration of the written warranty
(one year from date of shipment by TheDoorCompany.com for Fir, Hemlock
and Oak panel doors, five years for Mahogany panel doors and lifetime
for Innerbond® panels).
Some
states do not allow limitations on how long an implied warranty lasts,
so the above limitation may not apply to you. TheDoorCompany.com shall
not be liable for consequential, indirect or incidental damages, or for
any amount in excess of the purchase price of the defective door, whether
the claim is for breach of warranty or negligence. Some states do not
allow the exclusion or the limitation of incidental or consequential damages,
so the above limitation or exclusion may not apply to you.
This warranty
gives you specific legal rights, and you may have other rights which vary
from state to state.
How
To Make A Claim
Immediately upon discovering that the door is defective or fails to conform
to this written warranty, the purchaser shall send notice by using our
Warranty Claim Form.
Claims should
detail the date of purchase, description of the product, specific definition
of problem or defect, and your name, address and telephone number. TheDoorCompany.com
reserves the right and must be given at least a thirty (30) day opportunity
to have any door which is the subject of a warranty claim field inspected
by a representative of TheDoorCompany.com.
This limited
warranty extends only to the original purchaser of products or to the
original purchaser of the structure into which such products are installed.
